Lulzsec lads should not be in a criminal court according to the MET Police

Almost a life time ago (a year) it seems I reported computer misuse crime of which I was the victim, it was committed by a GP who unlawfully access my medical records and entered false records in to Prejudice me in making a complaint about the Doctors conduct and to further Pervert the Course of Justice (serious indictable offence).

The evidence was provided further the General Medical Council confirmed that the access was not permitted and therefore unauthorised. A serious crime, easy to prove and also fully evidenced.  The case was shut down within 1 hour, I received this email:

To: Winston Smith

Subject: Cris 3217210/11 refers

Dear Mr Smith 

I have tried to contact you on your mobile phone no. but phone was not connecting 

I am e-mailing you regarding the report you made to police in relation to an allegation of falsifying your medical records by doctor.

I have reviewed this case, and consulted with local CPS lawyer, who concluded thee was insufficient evidence to justify a criminal enquiry in this matter, as this can be brought to the relevant county court, where the doctor can give evidence in this case, and court can appoint an expert to examine the records. 

Therefore there will be no further criminal investigation in this matter.

Now let’s look at the Lulzsec lads situation, they are accused of crimes under the Computer Misuse Act, the MET are going to spend 3000 hours looking at Ryan Ackroyd evidence alone. If there is such a huge amount of time required the evidence surely cannot be that definitive. There would also appear to be considerable resource being expended in this investigation (3000 times what was spent on mine). Despite the significant effort required, the lack of definitive evidence of criminal conduct but they are going to investigate the matter anyway. 

This is despite the MET position being even if there were evidence this is a matter which should be brought to a civil court where an expert can be appointed to review the evidence. Please note that this email and opinion has been reviewed by many senior officers, including Borough Commander Jeremy Burton, and therefore is representative of the MET Police opinion on Computer Misuse investigations.

A clear precedent has been set by the MET Police that the Lulzsec lads should not be in a criminal court and that it is the responsibility of the alleged victims of the hacking to take action against them in civil proceedings if they feel it is necessary. To apply the law in a way that discriminates between people is a Human Rights violation , the law therefore applies to both the Lulzsec members and the Doctor.
